本規約は、achicochiのウェブサイト並びに全関連サービスのお客様によるアクセス及び利用に適用される、お客様とachicochiとの間の契約(以下「本契約」といいます)となります。

These Terms constitute an agreement (“Agreement”) between you and achicochi governing your access to and use of achicochi website and all associated services.

1. 予約確定

弊社が指定する支払い方法によってお客様が支払いを済ませた段階で予約確定とします。

1.Booking Accommodations

A booking is confirmed when a payment is successfully made by you with a payment method indicated by achicochi.life.

2. キャンセル

2.1.

予約のキャンセルまたは変更を希望される場合は、メールまたは指定された連絡手段によって弊社へ通知ください。

お客様が予約をキャンセルした場合、以下の条件で払い戻しを行います。ただし、自然災害、テロなど予測不可能な有事が発生した場合はこの限りではありません。

返金金額の割合（支払われた宿泊代に対して）

予約した宿泊開始日から起算して13日～当日キャンセルまたは連絡なしの不着 : 0%

予約した宿泊開始日から起算して30日前～14日前 : 50%

予約した宿泊開始日から起算して60日前～31日前 : 20%

予約した宿泊開始日から起算して61日以上前 : 100%

2.2.

登録施設側により確定済みの予約がキャンセルされた場合、ゲストには当該予約の総料金の全額が返金されます。

ただし、事前決済時にご利用されたクレジット・デビットカード会社によっては、手数料は返金不可能となる場合があります。

2. Booking Cancellations

2.1.

If you want to cancel or change your booking, contact us by email or other indicated communication tools.  

If you request a cancellation of a booking, we will refund according to the cancellation policy described below except in case of natural disaster, terrorism or any other unpredictable emergency.

Refunding percentage (of paid amount) *booking date means the first day of your stay 

13days before or less than 13 days from booking date (including No-show):0%

30 days~14 days before booking date:20%

60 days~31 days before booking date:50%

More than 61 days begore booking date:100%

2.2

If an accommodation cancels a confirmed booking, a guest will receive a full refund of the total fees for such booking.

Please note that certain transaction fees upon making payment may be non-refundable depending on your credit / debit card used for the transaction.

3. 決済

宿泊代の他、お客様が要求する清掃費やリネン交換などのサービスに対する費用を含め、代金の全額を予約時に事前決済いただく必要があります。

支払いは、第三者の決済会社を通じて、お客様のクレジット・デビットカードにて処理されます。

※京都ではおひとり一泊ごとに宿泊税が発生します。原則として滞在先にてお支払いください。

3. Payment

All the charged amount for booking including room charge, service requested by you such as cleaning and exchanging linen should be paid in advance upon making your reservation.

Payment is processed from your credit/debit card through third party payment processors. 

Visitors who have stayed overnight in lodging facilities in Kyoto City are required to pay The Accommodation Tax for staying at Kyoto payment processors. Please pay at the facility you stay.

4. 免責事項

4.1.

当社は、本サービスに事実上または法律上の瑕疵（安全性、信頼性、正確性、完全性、有効性、特定の目的への適合性、セキュリティなどに関する欠陥、エラーやバグ、権利侵害などを含みます。）がないことを明示的にも黙示的にも保証しておりません。

4.2.

登録施設が、ゲストが登録施設又は登録施設に存在する私物若しくはその他の財産に損害を与えた旨を、証拠を提示して請求する場合、登録施設はゲストへ損害賠償を求めることができます。

4.3.

当社は、本サービスに関して、ゲストと登録施設様との間において生じた取引、連絡または紛争等について一切責任を負いません。

4. Disclaimer

4.1.

Expressed or implied, achicocih LLC is not responsible for factual or legal defects on our service. (including safety, reliability, accuracy, completeness, effectiveness, suitability to certain purposes, luck of security, errors, bugs and infringement of lights)

4.2.

If an accommodation claims and provides evidence that a guest has culpably damaged an accommodation or any personal or other property at an accommodation, an accommodation can seek compensation for damage from a guest.

4.3.

achicochi LLC is not liable or responsible for any transaction, communication and dispute arose between a guest and accommodation. 

5. 知的財産権

特別に明記されていない限り、弊社のサービスやプラットフォームの利用に必要となるソフトウェア(プラットフォームの資料・情報・内容などの著作権を含む)の知的財産権は、合同会社achicochiに帰属します。

5. Intellectual Property Rights

Unless stated otherwise, intellectual property rights of the software required for our services or available at or used by our platform (including the copyrights of the contents and information of and material on our platform) are owned by achicochi LLC.,

6. 適用法、管轄、紛争解決

本利用規約と弊社のサービス提供は日本法に準拠し、同法にしたがって解釈されるものとします。

本利用規約またはサービス提供から生じる一切の紛争については、合同会社achicochiの本店所在地を管轄する裁判所の専属管轄権に服するものとします。

6. Applicable Law, Jurisdiction & Dispute Resolution

These terms and conditions and the provision of our services shall be governed by and construed in accordance with Japanese law.

Any dispute arising out of these general terms and conditions and our services shall exclusively be submitted to the court with jurisdiction over our head office location.

7. 一般条項

7.1. サービス内容の変更等

当社は、ゲスト、登録施設に通知することなく、本サービスの内容を変更しまたは本サービスの提供を中止することができるものとし、これによって生じた損害について一切の責任を負いません。

7.2. 利用規約の変更

当社は、必要と判断した場合には、ゲスト、登録施設様に通知することなくいつでも本規約を変更することができるものとします。

7. General Provisions 

7.1. Change of Service

We may change our service or stop providing it without any notification to a guest or accommodation. 

We are not responsible for any loss or damage caused due to the change or stop of our service. 

7.2. Change of Agreement

Agreement can be changed anytime we consider needed without any notification to guest or accommodation.
